We help with assessing the legal situation, acquiring the property right (registration with the relevant office), monitoring extension periods, and any infringing applications by third parties (trademark monitoring).
In the event of an infringement, we support you by initiating appropriate steps, such as issuing a warning and enforcing the rights in court (including interim legal protection).
We also support you in defending the property right against attacks, and in attacking (objection or cancellation proceedings) against the property rights of third parties, insofar as these are infringing or have been registered unlawfully.
German law is specific under several aspect:
Preliminary injunctions are mostly granted without (!) prior hearing. that is the case in most copyright- trademark- design and unfair competition matters.
German unfair competition law is different from what you might know. It is a very unique field of additional protection (might also include aspects of design if no other law is applicable)
